Boost Your Job Applications with Data Privacy Certifications 

This is an exciting decade for aspiring and acting privacy professionals, as overall data privacy regulation is evolving towards strengthening consumer protection. 2020 and the beginning of 2021 were full of privacy firsts with several consumer data protection laws taking effect throughout the country.  

Examples of state level data privacy protection legislation in 2020 and 2021 that were enacted:

  • California - The California Consumer Protection Act (CCPA) went into effect in January 2020 and on 11th December 2020, the California Consumer Privacy Rights Act (CRPA) became effective further expanding consumer privacy rights. The CRPA also creates the first state privacy agency in the US, the California Privacy Protection Agency (CPPA) that will enforce the CPRA, the new California privacy laws and take action against privacy violations. Recently, the five-member inaugural board for the CPPA was appointed.

  • Texas - The Texas Privacy Protection Advisory Council issued a report in September 2020 outlining recent state legislative actions regarding privacy and compliance challenges. The report included legislative guidance on how to enhance consumer protections and strengthen Texas privacy regulations.

  • Virginia- In February 2021, Virginia’s Senate and House passed the state’s Consumer Data Protection Act (CDPA). On March 2, 2021, the CDPA was signed into law. The CDPA applies to businesses that conduct business in Virginia and either control or process personal data of 100,000 consumers or process personal data of at least 25,000 Virginia consumers and derive 50 percent of their gross revenue from selling personal data.

Conversations about similar state-level legislation are taking place in Minnesota, Washington, New Hampshire, Illinois and Oklahoma. As data privacy regulations increase, affected companies will need more certified privacy professionals to ensure their operations meet regulatory demands.  

Data privacy laws are taking effect within other countries as well. The EU’s General Data Protection Regulation (GDPR) inspired the drafting of similar privacy legislation and the enactment of privacy regulations throughout the world. These new laws can impact how US businesses operate within these countries. 

Examples of recent international data privacy legislation and regulation: 

  • Brazil’s Lei Geral de Proteção de Dados (LGPD) provides critical clarification to Brazil’s existing legal framework. The LGPD protects sensitive personal data that is susceptible to discriminatory practices including race, ethnicity, religion, health, genetic data, biometric data, etc.

  • Canada’s Consumer Privacy Protection Act (CPPA) is a bill that if adopted will enable consumers to exercise their privacy rights and control their data. The CPPA also promotes improved transparency regarding how organizations use data containing personal identifiers.

  • Nigeria’s Data Protection Regulation (NDPR) was established to regulate the collection and processing of personal information of Nigerians. The regulation provides data processing principles, the rights of data subjects and sanctions for failure to observe the regulation. A new Data Protection Commission will ensure NDPR compliance.

  • Australia’s Consumer Data Right (CDR), which launched in 2020, gives consumers greater control over their own data, including data with a trusted third part. Consumers have control over what data is shared and how it is used. Consumers can stop the collection of their data at any time and request for it to be deleted if it is no longer needed.

How does the rapidly evolving data privacy landscape impact the privacy profession? Data privacy is an increasingly regulated and specialized field. Large and small businesses find privacy compliance difficult and will need more data privacy experts as privacy regulations continue to grow.
